Terms of service

Draft. This is a plain-language skeleton written to cover the risks this business actually has. It is not legal advice and has not been reviewed by a lawyer. Have one look at it before you take money.

1. What you are buying

One engraved marker, shipped to you, and one memorial page reachable at a fixed web address. The page may hold up to two people who share a single monument. One payment; no subscription.

2. Who may create a memorial

By creating a memorial you confirm that you are a family member, executor, or otherwise a person with a legitimate connection to the deceased, and that you have the right to publish the photographs and text you upload. You are responsible for that content.

3. Competing claims

Where two or more people assert a claim over the same memorial, we may suspend the page while we look into it. We will try to reach everyone involved. We are not a court and we cannot adjudicate family disputes; where a matter cannot be resolved, we may keep the page suspended.

4. Review and removal

All content is reviewed before publication against our published standards. We may decline to publish, or later remove, anything that breaches them. We may suspend a memorial pending review of a report.

5. Installation on a monument

You are responsible for obtaining any permission required by the cemetery, memorial park, or monument owner before affixing the marker. We are not liable for damage to a monument, for removal by a cemetery, or for any dispute arising from installation.

6. Refunds

Full refund at any time before the marker enters engraving. After engraving it is a personalised item and is generally non-refundable, though we will replace a marker that arrives faulty or is engraved incorrectly through our error.

7. Availability

We intend the memorial page to remain available indefinitely and have described the steps we take toward that on our permanence page. We cannot guarantee perpetual availability, and nothing here should be read as such a guarantee. We will give notice and provide a full archive before any discontinuation.

8. Your content

You keep ownership of everything you upload. You grant us only the licence needed to store, review, and display it on the memorial page. We do not sell your content or use it for advertising.

9. Limitation of liability

To the extent permitted by law, our total liability is limited to the amount you paid. We are not liable for indirect or consequential loss.
